1. Acceptance of Terms
By accessing or using Pract.is’s website and services (the “Service”), you agree to be bound by these Terms of Service and our incorporated policies (Privacy Policy, Cookie Policy, Acceptable Use Policy). If you do not agree, do not use the Service.
2. Description of Service
Pract.is provides a platform for musicians to discover repertoire, track practice, connect with teachers, and engage with a community. We may modify, suspend, or discontinue the Service at any time without liability.
3. User Accounts
You must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. Notify us immediately of unauthorized use.
4. Acceptable Use
You must comply with our Acceptable Use Policy. Prohibited activities include violating laws, impersonating others, spamming, interfering with security, or introducing malicious software.
5. Intellectual Property
The Service and its content are the exclusive property of Pract.is and its licensors. Our trademarks may not be used without prior consent.
User Content: You retain ownership of content you submit but grant Pract.is a worldwide, non-exclusive, royalty-free license to use and display it in connection with the Service.
6. Privacy and Cookies
Your use of the Service is also governed by our Privacy Policy and Cookie Policy.
7. Payment Terms
If you purchase paid services, you agree to pay applicable fees in accordance with our billing policies. Fees are non-refundable unless required by law or explicitly stated. For EU/EEA consumers, statutory withdrawal rights apply as provided by law.
8. Termination
We may suspend or terminate your account immediately if you breach these Terms. Provisions that should survive termination (e.g., intellectual property, limitations of liability, indemnity) will continue to apply.
9. Disclaimers and Warranties
The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Pract.is shall not be liable for indirect or consequential damages. Our total liability shall not exceed the fees you paid in the 12 months prior to the claim.
11. Indemnification
You agree to indemnify and hold Pract.is, its affiliates, and staff harmless against claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Age Restrictions
The Service is not directed to children under 13. In the EU/EEA, you must meet the minimum digital consent age set by your country (between 13–16). If you are under 18, you may use the Service only with parental or guardian involvement.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Austria. Any disputes shall be subject to the exclusive jurisdiction of the courts in Vienna, Austria, unless mandatory consumer protection laws provide otherwise.
14. Changes
We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
